Sorry about that last incomplete reply.
We discussed this issue yesterday at my oversight hearing on ABRA. The
penalties vary depending on whether the noncompliance is "substantial" and,
for those cases, includes revocation, suspension and other actions. Of the
60 audits (taking as much as five days to conduct) conducted thus far, only
4 noncompliant licensees have been identified. We re finding that the
number, while of concern, is much less than many had assumed. I suggest you
hold your judgments until we see what the actions are.

Jim - I have no doubt that the auditors will be able to find the violations.
Rather, my fear is that the Board will not impose sufficient penalties in
response, any more than it penalizes any other violation of the ABC laws,
some far more serious than the food minimum. Can you give us some idea as
to what penalties you anticipate that the Board will impose? ----- Original

You are right about the lack of enforcement of food requirements in the
past, but I think the situation will be markedly different in the future.
What we have done is to fund auditors to get the information we need in
order to be certain that the licensees is out of compliance. It is (unlike
the past) a very deliberate effort. And we will soon reach the point of
being able to meaningfully enforce the requirement. Bests Jim
